2 What Is Malaysian Stamp Duty?
Property stamp duty in Malaysia is a tax on written documents in property transactions. The two main documents are the Memorandum of Transfer (MOT) for ownership transfers and the Loan Agreement for bank financing.
For Citizens
Progressive rates apply (1% to 4%), with eligibility for various government exemptions.
Non-Citizens
From 1 January 2024, a flat rate of 4% applies to transfer instruments for foreign nationals.
3 First-Home Exemption
Under Budget 2024, first-home buyers qualify for a full (100%) stamp duty exemption on the MOT and Loan Agreement for properties valued at no more than RM500,000. This exemption is valid until 31 December 2025.
